In Lopsided Vote, Montana Voters Express Disapproval of Citizens United

Montanans aren’t giving up the fight after the U.S. Supreme Court affirmed in June that the Citizens United campaign finance ruling applies in the state.

Seventy-five percent of Montana voters on Tuesday approved an initiative calling for a constitutional amendment to overturn Citizens United, report the Wall Street Journal Law Blog and Courthouse News Service. The 2010 decision held that corporations have a First Amendment right to expressly support political candidates with independent spending.

The Montana Supreme Court had ruled in January that Citizens United didn’t apply in the state because of its unique history of corruption, but the U.S. Supreme Court overturned that decision in June.

According to the initiative, the state’s congressional congressional delegation should propose the constitutional amendment establishing that “corporations are not human beings with constitutional rights.”
