Lawyer for convicted murderer says he obtained the gun possibly used by the real killer

A lawyer who represents a double-murder defendant says he received a handgun from a woman who said it was used by the real killer in one of the crimes.

Judge Alex Renzi pushed back the sentencing of defendant Michael Walton until Jan. 7, the Rochester Democrat and Chronicle reports. Walton was originally scheduled to be sentenced Wednesday for slaying two people, the first in February 2013 and the second in August 2013.

Lawyer David Morabito of East Rochester, New York, said he turned the handgun over to authorities last week, the story says. The woman who gave Morabito the gun said someone other than Walton had confessed the August murder to her. She had made the same assertion to police a year ago, according to the lawyer’s account.

Morabito said neither he nor prosecutors were told that about the woman’s reported contact with police. The person the woman identified is currently in jail for another crime, Morabito said.
