Wis. Judge Dismisses County Action Challenging Collective Bargaining Law

Government officials representing Dane County, Wis., can not sue to block the state’s controversial law restricting public employee collective bargaining rights, a state court judge there ruled Thursday.

According to the Wisconsin State Journal, Dane County Circuit Judge Maryann Sumi found that the county and officials representing it do not have the authority under state law to challenge the constitutionality of state laws.

Sumi did not rule on whether Kathleen Falk, the county executive, and County Board Chairman Scott McDonell can sue the state in their personal capacities as taxpayers. A hearing is scheduled to determine if Sumi will consider those additional challenges, which were filed in a second amended complaint earlier this week.
