Caitlyn Jenner won't be charged in fatal car crash but faces ongoing civil suit

Although Caitlyn Jenner was driving within the speed limit, she was driving too fast for conditions when she rear-ended another vehicle in February as she was towing a dune buggy behind a SUV, officials say.

The accident on California’s Pacific Coast Highway proved fatal to the driver of the rear-ended Lexus, which was sent into the path of an oncoming Hummer by the crash. But the evidence doesn’t show that Jenner, who applied her brakes 4.2 seconds before the accident, was distracted, so the Los Angeles District Attorney’s office says she won’t be criminally charged, the Los Angeles Times (sub. req. ) reports.

“Based on the facts, cannot prove beyond a reasonable doubt that the suspect’s conduct was unreasonable,” prosecutor Patricia Wilkinson wrote in a document declining to charge Jenner.

A civil case filed by the family of the Lexus driver, Kim Howe, is ongoing.

“We are heartened the district attorney has agreed that even a misdemeanor charge would be inappropriate,” said Jenner’s lawyer, Blair Berk. “A traffic accident, however devastating and heartbreaking when a life is lost, is not necessarily a criminal matter.”
