Former NJ Judge Is Accused of Representing Mayor While on City's Municipal Court Bench

A former judge in Montville, N.J., is accused of continuing to represent the city’s mayor in real estate matters, while simultaneously sitting on the municipal court bench.

Seth Davenport faces two legal ethics counts concerning his alleged work for then-Mayor John Rosellini, the Daily Record reports.

First, the Supreme Court’s Advisory Committee on Judicial Conduct contends, Davenport’s representation of Rosellini between January 2003 to December 2004 was in itself a violation of a state ethics rule.

Second, the ACJC alleges, Davenport signed a certification in October 2006 that stated he had “completely ceased” his “representation of John Rosellini” after he became a municipal judge, but that wasn’t true. This adversely affected the integrity of the judiciary, the complaint says.

The newspaper said it tried to reach Davenport today without success. Rosellini declined comment.
