NJ Lawyer’s Penis Enlargement Product Lawsuit is Revived on Appeal

Unhappy with the mail-order penis enlargement product he bought in 2007, a New Jersey attorney was also unhappy with the initial result of the class-action consumer fraud litigation he brought over the purchase.
But an appeal of the trial court's dismissal of the case may have a more satisfying outcome for attorney Harold Hoffman of Englewood. Although a three-judge appellate panel held that Hoffman failed to prove any "ascertainable loss," it also found that the trial court erred by not allowing Hoffman to amend his pleadings to make such a showing, reports the Newark Star-Ledger.
Hoffman now intends to follow through with an amended filing.
