A self-employed painter and decorator in Wales has been given an expensive ticket for violating a law against smoking in the workplace–in this case, his own unmarked van.

Because the £30 (approximately $60) ticket from the Ceredigion council doubles if it isn’t paid in a fairly short time, the offender’s wife, 56-year-old Sue Williams, went ahead and paid it. However, both she and her husband, Gordon, 58, question how it can be that it is illegal for him to smoke in their own private vehicle, reports the London Times.

“I am dumbfounded. The van is only insured for private use and to get me to and from work,” Gordon Williams tells the newspaper. “It is not my place of work. I decorate houses, not vans. I don’t use it for work so I can’t see how they can do me for smoking in the workplace.”

He says he plans to appeal the ticket, even though it’s already been paid.
