Judge Tells Lindsay Lohan She Will Go to Jail If She Takes Offered Plea in Necklace-Theft Case

A lawyer for actress Lindsay Lohan reportedly had been trying to negotiate a plea deal in a necklace-theft case that would not involve any jail time.

However, a California judge told Lohan in court today that any sentence he gives her if she pleads guilty or no contest would involve jail time, according to the Associated Press and Entertainment Weekly.

The felony grand theft case Lohan faces is compounded by the fact that she is already on probation concerning prior driving-under-the-influence cases.

She is accused of taking the $2,500 item from a jewelry store in Venice, Calif. Law enforcement sources say surveillance footage shows the 24-year-old actress wearing the necklace in the store and papparazzi photos taken outside the store days later show her wearing it then, reports the L.A. Now blog of the Los Angeles Times.

Lohan and her lawyer, Shawn Chapman Holley, are due to appear again in Los Angeles Superior Court on March 10, after she has time to consider the plea.

“This case does involve jail time—period,” Circuit Judge Keith Schwartz told the actress this morning at a hearing at the Airport Courthouse. “If you plead in front of me—if this case resolves in front of me—you are going to jail. Period. It may be an issue as to amount of time.”
