Fired Cocktail Waitresses Sue, Claim Casino Wanted Sexier and Younger Workers

Nine cocktail waitresses claim in a lawsuit that they were fired by the Resorts Casino Hotel in Atlantic City to make way for women who were younger, slimmer and sexier.

The suit follows two other discrimination suits filed in March by 46 cocktail waitresses also fired by the Resorts Casino Hotel, the Press of Atlantic City reports. The waitresses say they were fired because they were deemed insufficiently sexy for the casino’s new Roaring 20s uniforms.

Gloria Allred represents the women in the latest lawsuit along with New Jersey lawyer Virginia Hardwick, the Philadelphia Inquirer reports. Their suit contends the plaintiffs were forced to try out for jobs in the new uniforms by posing for photographs in unflattering poses that emphasized body fat. The women were fired after helping train younger waitresses who then replaced them, the suit claims.

The Resorts Casino Hotel released a statement saying cocktail servers were given “individualized consideration” and those who lost their jobs were given hiring preference in other open positions. “Resorts is confident that it has acted in accordance with all legal requirements in its employment decisions,” the statement said.
