Virginia Gov. Timothy Kaine is considering an executive order to make sure mental health information is in a database used in background checks of gun buyers, according to the Washington Post.

That kind of information would have barred gun sales to Seung Hui Cho, the Virginia Tech student who went on a shooting rampage last week.

Kaine’s staff is researching whether legislative approval is needed for the change.

Virginia reports involuntary commitments to the FBI for its database. A judge had ordered Cho to receive outpatient treatment and did not order commitment.
