Supreme Court Won’t Hear Extraordinary Rendition Lawsuit Derailed by State Secrets Privilege

The U.S. Supreme Court has refused to hear a challenge to the CIA’s “extraordinary rendition” program by five men who claimed they were sent to other countries to be tortured.

The Supreme Court denied cert in the suit against Jeppesen Dataplan Inc., a subsidiary of Boeing accused of helping to arrange overseas flights for the government program, report Bloomberg News and the San Jose Mercury News.

The 9th U.S. Circuit Court of Appeals based in San Francisco had dismissed the suit last year on a 6-5 vote, siding with the administration’s arguments that the suit could expose state secrets and pose an unacceptable security risk.
