Brooke Astor’s Son Sentenced to Up to Three Years in Prison

Brooke Astor’s son, Anthony Marshall, has been sentenced to one to three years in prison for diverting millions of dollars from his mother’s estate as her mental capabilities declined.

Prosecutors had sought a sentence of up to 4½ years in prison after Marshall’s conviction in October, according to the New York Times. Judge A. Kirke Bartley Jr. sentenced the 85-year-old Marshall to three years in prison on the most serious charge—that he misused his power of attorney to pay himself a $1 million retroactive lump sum for managing his mother’s money. Bartley imposed one-year concurrent sentences on 13 other charges.

Today’s sentence followed lengthy presentations by both the prosecution and defense, the Times says. Assistant District Attorney Joel Seidman said Marshall engaged in “grand theft Astor” and he was “nothing more than ‘a thief in a three-piece suit,’ ” according to the Times.

The defense presented letters from more than 75 of Marshall’s friends, including Whoopi Goldberg and Al Roker.

Marshall was ordered to report to prison Jan. 19.
