Ex-MoFo Partner Pleads Not Guilty to Bilking Autism Services for Son

A former Morrison & Foerster partner and his wife pleaded not guilty Friday to charges they bilked a school district and two insurers out of nearly $400,000 in homeschooling expenses for their autistic son.

Jonathan Dickstein, an intellectual property lawyer, and his wife, Barclay Lynn, a marketing consultant, are facing 31 felony charges, including grand theft, forgery, insurance fraud and conspiracy, according the Recorder.

Prosecutors accuse the couple of creating a dummy company, ostensibly to create treatment plans for their son, which they are alleged to have used to double-bill both the San Francisco school district and insurers for the same special education services.

Dickstein’s lawyer, Garrick Lew, admitted at the time of his client’s arrest last month that the couple had encountered “problems” trying to get their son’s needs met. Lynn’s lawyer said there was “some indication” the couple’s conduct could be construed as lawful.

The couple, who are fighting to keep the arrest affidavit in the case secret, filed a motion earlier this week to keep the 163-page document sealed. The judge in the case Friday gave the district attorney’s office time to respond to the motion.
