An all-time high of 1,500 federal cases regarding trade secrets were filed in 2025, nine years after the enactment of the Defend Trade Secrets Act in 2016, according to a new report.

The report, from legal analytics company Lex Machina, analyzes data from 2016 to 2025 and shows that cases settle less often and take longer to resolve as plaintiffs lean on federal and state claims to walk through shifting legal standards, according to the story.

The U.S. District Court for the Central District of California, the U.S. District Court for the Southern District of New York and the U.S. District Court for the Northern District of Illinois—all top commercial and tech hubs—lead all court filings from 2023 through 2025, Law360 reports.
