In a case some might have thought to be a relic of legal history, a 41-year-old woman has been charged with adultery after allegedly having sex on a picnic table in a public park in Genesee County, N.Y. It is reportedly only the 13th adultery case pursued in New York state since 1972.

Suzanne Corona was also charged with public lewdness by Batavia police. Her 29-year-old co-defendant, Justin Amend, isn’t married and hence is charged only with public lewdness, according to WPIX-TV.

The county’s district attorney, Larry Friedman, tells 13WHAM that this is only the second time in his 28 years in practice that he’s seen an adultery case.

While some observers are questioning the prosecution, “obviously we’re not the ones that make the laws nor do we determine if existing laws should be continued. That’s a legislative decision, and it’s there,” says Friedman of the state’s law against adultery. The Class B misdemeanor carries a maximum penalty of three months in jail.

Corona doesn’t deny having sex but tells the station that what occurred has been blown out of proportion. Although WPIX says a stunned mom called 911 after witnessing the steamy situation, Corona insists to WHAM that there was nothing to be seen and no one was nearby.

She plans to fight the adultery charge.
