An investor suit filed against SeaWorld on Tuesday claims the company failed to disclose the impact of the documentary Blackfish, which highlighted killer whales in captivity, including a whale involved in three deaths.

The suit filed in California federal court says the company didn’t initially disclose a link between falling attendance and bad publicity surrounding Blackfish, report the Hollywood Reporter, the Orlando Sentinel and the Voice of San Diego.

The would-be class action, which names Lou Baker as a plaintiff, said SeaWorld improperly cared for Orca whales and continued to feature a whale that had killed and injured trainers. The whale killed SeaWorld trainer Dawn Brancheau in 2010. The whale had also been involved in two previous deaths, according to prior coverage by the Orlando Sentinel.
