Judge Refuses to Dismiss Skinny-Dipping Suit, at Least for Now

A judge in New York state has refused to dismiss a lawsuit brought by three skinny-dipping young women who claim observers on shore hid their clothes and then “pummeled” one of the plaintiffs when she tried to retrieve her belongings.

Judge Joseph McGuire said it would be premature to dismiss the suit or to declare the plaintiffs’ claims frivolous, although the defendants’ lawyer “has made a strong argument for a finding of frivolous conduct, albeit being based on questionable parental motives,” the Watertown Daily Times reports.

The skinny dippers, all from the Syracuse area, are suing for assault and false imprisonment. McGuire ordered the defendants to relinquish their computers so an expert selected by the court can determine if they hold relevant evidence. The lawyer for the plaintiffs contends e-mails and text messages on the computers’ hard drives can help resolve conflicting deposition testimony.

The lawyer for the defendants claims the suit is part of a vendetta.
