Chobani can face lawsuit over no-sugar yogurt claim, 7th Circuit rules

A class action lawsuit claiming that Chobani violated state consumer protection laws by falsely advertising some of its Greek-style yogurt as sugar free can move forward, the 7th U.S. Circuit Court of Appeals at Chicago ruled Monday.
7th Circuit Judge Thomas Kirsch, writing for a three-judge panel, found persuasive a Food and Drug Administration brief stating that total sugars included all monosaccharides, including allulose.
Chobani has claimed that the 4 grams per serving of allulose, a naturally occurring sweetener, did not qualify because the FDA regulation listed only glucose, fructose, lactose and sucrose as examples. Kirsh rejected the argument.
James Franco and Abigail Franco, the plaintiffs, said they bought Chobani Zero Sugar Greek-style yogurt at a Costco near Chicago in 2023, but they would not have bought it or would have paid less if they had known its sugar content.
