A Texas justice of the peace is under investigation after having a verbal exchange with several teenagers inside a 24-hour burger restaurant that later allegedly escalated into physical blows with one teen.

Jason Hearne, a Young County justice of the peace for Precinct 1 in Texas, allegedly encountered social media influencer Danny Duncan, along with his film crew inside Whataburger in Graham, Texas, around 1 a.m. Sunday.

Teenage fans of Duncan’s vied for a photo with the social media personality, which reportedly caused Hearne to comment on whether two men should be taking a photo together and insinuating that the teens were gay, according to coverage by Chron.com.

Later in the Whataburger parking lot, one witness said the teen allegedly “turned around to look at him, talk to him, and he [Hearne] just punched him in his face.”

Neither Hearne nor the teen have commented on the altercation. But Young County District Judge Coordinator Terri Rhodes provided a statement to the media.

“At this time, [District Judge Phillip Gregory] indicates that he is aware of the circumstances and believes the matter to be under an active investigation,” Rhodes said.
