SCOTUS drops case after pro se litigant goes missing

The U.S. Supreme Court has dropped the case of Bobby Chen, who filed a pro se cert petition over the power of federal judges to extend the time for service of lawsuits.

The court dismissed the case on Friday because Chen could not be found, report the Wall Street Journal, the Wall Street Journal Law Blog, the Associated Press and SCOTUSblog. Chen never filed his opening brief on the merits and didn’t provide a phone number. His email address doesn’t work and he can’t be found at the address he listed in Flushing, New York.

Chen’s lawsuit against Baltimore officials claimed the city tore down his row house to hide damage created when it tore down a building next door. The suit was tossed when Chen missed a deadline to serve legal papers.
