Five North Carolina district attorneys and the president of the North Carolina State Bar are defending a state law banning paralegals from offering legal advice as the 4th U.S. Circuit Court of Appeals at Richmond, Virginia, reviews a First Amendment challenge to the law.
In a brief filed last week, the district attorneys and state bar asked the 4th Circuit to uphold a trial judge’s 2024 decision to dismiss a case challenging the law, according to a story by the Carolina Journal.
“Licensure requirements for lawyers that apply regardless of the specific nature of legal advice conveyed are regulations of conduct that are allowed under the First Amendment,” according to the brief.
The plaintiffs in the case said they are trying to expand access to justice in North Carolina.
